1. Who We Are
FlexYourMarkers (“FYM”, “we”, “us”) is an educational software service provided under the trading name DAMS Labs via the website flexyourmarkers.com (the “Service”).

2. Educational Only — No Medical Advice
FYM is provided for educational and informational purposes only. FYM does not diagnose, treat, prevent, or monitor any disease, and it is not a medical device or clinical decision tool. Content and outputs may be incomplete, delayed, or inaccurate and must not be used as a substitute for professional medical advice.
3. Eligibility
You must be at least 18 years old to use the Service. By accessing or using FYM, you confirm that you meet this requirement.
4. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree not to share or resell access to the Service.
5. Your Uploaded Lab Reports and Data
You retain ownership of lab reports, images, and other materials you upload (“User Content”). You grant FYM a limited licence to host, store, process, and display User Content solely to operate and improve the Service for you, including converting documents into a structured, educational format.
FYM does not publish your User Content to the public by default. However, you understand that any sharing features you choose to use (if available) may make selected content visible to recipients you specify.
6. Automated Processing (Including AI)
FYM may use automated systems to extract and organise information from uploaded documents. These systems may include machine-learning or AI models. Automated extraction can produce errors, omissions, or incorrect interpretations; outputs are provided for educational display and are not clinical results.
7. Acceptable Use
You agree not to misuse the Service, including attempting to bypass security, probe or scan systems, interfere with normal operation, introduce malicious code, scrape or harvest data, or use FYM in a way that is unlawful or that misrepresents outputs as medical advice or diagnosis.
8. Intellectual Property
The Service (including software, interface, branding, and educational content provided by FYM) is owned by us or our licensors and is protected by applicable intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable licence to access and use the Service for your personal, lawful, educational use.
9. Payments and Merchant of Record (Paddle)
If paid features or supporter purchases are offered, payments are processed by Paddle as the Merchant of Record. This means your purchase is made from Paddle, and Paddle’s buyer terms apply to the transaction.

10. Refunds, Cancellations, and Disputes
Refund requests and payment disputes for purchases processed via Paddle are handled under Paddle’s buyer terms and processes. If a refund is approved, it is issued by Paddle to the original payment method, subject to payment method and transaction-age limitations.

11. No Warranties
The Service is provided “as is” and “as available” for educational use. To the maximum extent permitted by law, we disclaim warranties of any kind, whether express, implied, or statutory, including warranties of accuracy, completeness, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the maximum extent permitted by law, FYM will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business opportunities arising from or related to the Service.
To the maximum extent permitted by law, FYM’s total liability for any claims arising from the Service is limited to the amount you paid for the Service in the 12 months before the event giving rise to the claim (if any).
13. Suspension and Termination
We may suspend or terminate access to the Service if we reasonably believe you have violated these Terms, created legal or security risk, or used the Service in a way that could cause harm to FYM or others.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date on this page. Your continued use of the Service after changes take effect means you accept the updated Terms.
15. Governing Law
These Terms are governed by the laws of England and Wales, unless your local mandatory consumer protections require otherwise.
16. Severability
If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect.
